Operation Against Lashkar-E-Islam Begins In Landi Kotal

LANDI KOTAL: Security forces today launched operation against Lashkar-e-Islam after curfew was enforced in Landi Kotal. Political Agent of Khyber Agency, Tariq Hayat Khan told Geo News that Mangal Bagh has moved to Terah from Kotal. He said nobody would be allowed to challenge the writ of government. Meanwhile, Political administration has enforced curfew in Landi Kotal, threatening to tract strict actions against its violation. Khan said, “Security forces arrested recovered weapons and arrested 10 absconders from Peshawar-Turkham road.” He further said that the operation would continue in Landi Kotal till its logical end. He said the supporters of Lashkar-e-Islam will have to lay down arms and offer their custody.

Siddons Wants More From Bangladesh

DARWIN:Bangladesh coach Jamie Siddons has challenged his side to show more consistency and trouble the world’s best teams on a more regular basis.

Siddons, who was a prolific batsman in Australian first-class cricket for many years but never played at the top level, was speaking here Friday as his team prepared for a three-match one-day series against world champions Australia.

The series, which will be played on drop-in wickets prepared in Queensland, was scheduled as a warm-up for the now-postponed Champions Trophy.

Despite being without captain Ricky Ponting, opener Matthew Hayden and speedster Brett Lee, the home side is expected to be far too good.

Bangladesh can take some heart from an upset win over Australia in Cardiff in 2005, when Siddons was an assistant coach for the Australians, but he said it was time Bangladesh became a respected foe in international cricket.

Siddons said his team had shown it could upset the best in the world, but with just 40 wins in 184 one-day internationals they needed to do so far more often.

“We always talk about the fact that we have a win here, we have a win there,” he said. “We’re trying to be more consistently competitive. Snatching a win here and snatching a win there is not what I’m about in the future, it’s about being consistent. “Coming to Australia and everyone knowing that we can be competitive, not asking ‘Do you think you might win a game?’ “‘How many games are you going to win?’ is what I want people to ask.” Bangladesh has won just one of its last 12 one-day internationals, and that was against the United Arab Emirates.

Not since April 2007 at the World Cup, when they upset South Africa by 67 runs, have they beaten one of the premier sides in world cricket, with 24 losses in succession against Test-playing nations.

Michael Clarke, who will lead Australia in the absence of Ponting, said the Australians would not be taking their opponents lightly.

“As soon as you take things for granted I think you find yourself asking questions why you’ve lost that game,” he said.

FED on Franchise Fee: SHC Wants Karachi LTU To Explain Legal Position

ISLAMABAD:Sindh High Court (SHC) has directed the Large Taxpayer Unit (LTU), Karachi, to explain legal position of past recovery of the Federal Excise Duty (FED) on franchise fee, paid by the franchisee during the last two years without issuance of an adjudication order to the unit.

Sources told Business Recorder on Thursday that the LTU, Karachi, adjusted the amount of the FED against the sales tax refund without passing any order of adjudication. Secondly, it has to be clarified that as per section 3 of the Federal Excise Act, 2005, the FED is to be paid by the service provider, whereas the Rule 43A provided the receiver of the service to pay FED on franchise fee. This was a direct contradiction of Federal Excise Act and Federal Excise Rules.

In the 2008-09 budget, the FBR has amended the Federal Excise Act to remove distortion in the law, which confirmed that there was an anomaly in the law. As the recovery amount is related to the past cases, the previous status of law has been quoted in the case.

Sources said that the anomaly was challenged in writ jurisdiction of the Sindh High Court (SHC) by Hinopak Motors through Syed Naved Andrabi, advocate, Supreme Court, after their payments on account of franchise fee made to Hino Motors, Japan, during July 1, 2006 to June 30, 2008, were arbitrarily charged with the FED.

The advocate informed that the officers of the Federal Excise at the LTU, Karachi, without passing any order of adjudication, recovered the amount of FED by adjusting the same against sales tax refund.

It was informed that the arbitrary action of the officers of the FED at LTU, Karachi, was challenged before the Sindh High Court under Constitutional Jurisdiction on the grounds that the FED, in case of services, were to be paid by the service provider, whereas the same was being recovered from the recipient of the services. “Similarly, no recovery of a tax can be made unless an adjudication order has been passed and that too after giving an opportunity of being heard.”

The division bench of Sindh High Court, comprising Justice Allah Sain Deno Matelo and Justice Bin Yamin, issued pre-admission notice to the department to explain the position on the grounds raised in the petition.

It is worth mentioning that the FBR had received a number of complaints from the field formations that some taxpayers evade the payment of duty on the pretext that they do not pay franchise fee rather they pay technical fee or royalty. The technical fee payment comes within the purview of franchise services, the excise duty was not paid due to unclear specification in the excise law.

In view of the situation, definition of “franchise services” has been enlarged by including technical fee in it through Finance Act 2008. The definition of franchise has also been shifted from Federal Excise Rules, 2005 to Federal Excise Act, 2005.

4 Killed In Iraq Bombing

BAGHDAD: An Iraqi police official says that a bomb planted in a parked car killed four people and wounded six, including three policemen, in the city of Tikrit, north of Baghdad.

The official says Tuesday’s blast occurred at 7:30 a.m. on amajor Central Street used by local government officials to go to work.

The official spoke on condition of anonymity because he is nota uthorized to speak to the media.

Bush Gives Phone Call To PM Gilani

ISLAMABAD: US President George W. Bush Thursday telephoned Prime Minister Yousuf Raza Gilani and congratulated him over the smooth transition of power.

Speaking to reporters in Parliament, Information Minister Sherry Rehman said the U.S. President phoned Pakistani Premier Yusuf Gillani and congratulated him on the smooth transfer of power

She said that Bush assured Gilani of his continued support for Pakistan and its government.

Sherry Rehman went on to say that the schedule for electing a new president would be announced in the next two days.

Peshawar Amid Other Districts Endure Prolonged Load-Shedding

PESHAWAR: The spate of prolonged and unannounced load-shedding of electricity in the provincial capital city here including other districts continued, which has triggered acute shortage of water also in several areas, paralyzing the normal life of the people.

University Town, Gulbahar, Rashidabad, Bashirabad, Wazirbagh Road, Haji Camp, Nothia and old city areas bore the main brunt of 6 to 8 hours of load-shedding, which continued in the night also, forcing the people to pass sleepless nights. Protracted power outage has caused acute shortage of water also in several areas. Besides Peshawar, Abbotabad, Charsadda, Nowshehra, Mardan and other districts as well suffered load-shedding with no respite. Citizens have demanded cutting short the load-shedding time in summer season.
