HC Reserves Decision on Sex Scandal Case

Srinagar, May 27: A full bench of the Jammu and Kashmir High Court today reserved its decision on a sex scandal case involving politicians and bureaucrats. A Division Bench last year gave a split decision on the future course of action by a subordinate court against those named in the scandal.The bench comprising Justices Nisar Ahmad Karu, J P Singh and Virender Singh reserved the judgement after hearing the arguments from the counsels of Kashmir High Court Bar Association, Assistant Solicitor General who is representing the CBI and Advocate General of the state.The Bar Association had filed a public interest litigation in 2006.The case was referred to a full bench by Chief Justice K S Radhakrishanan after the division bench comprising Justices Hakim Imtiyaz Hussain and Bashir Ahmad Kirmani gave a split decision.The state government had handed over the case to Central Bureau of Investigation (CBI) following massive demonstrations across the valley.A total of 18 people, including two former ministers and an IAS officer, were arrested for their alleged involvement in the case.All the accused are out on bail while they are undergoing trial in a Chandigarh court. The case was shifted out of the state by the Supreme Court as the accused had expressed apprehensions that they may not get a fair trial here in view of the charged atmosphere.The Division Bench of the court which was monitoring the investigations by the CBI, last year named some more persons including a minister and an MLA for their alleged involvement in the case.
